The Process

Judgment collection process in Florida
                              
 All of the judgments are purchased and processed on a future pay/contingency basis.
This means that we will cover all the expenses incurred in the recovery process of your judgment,
 for the exceptions of certain circumstances that will be listed in the Acknowledge of
Assignment Agreement. Once monies are recovered, you will received the percentage
which you agreed upon with your recovery specialist. We do not charge an application
fee, or charge to evaluate your case, there is no risk or obligation on your part.
Once you have consulted with a recovery specialist and agreed to assign your
judgment to Sigma Recovery Group to be enforced, we will immediately initiate
the necessary steps to start collections.

 One form will need to be signed by you and mailed back to us:
  • Acknowledgment of Assignment of Judgment/Contingency Fee Agreement form
 The Acknowledgment of Assignment of Judgment/Contingency Fee Agreement form
 is a standard form for which transfers the rights to collect on the judgment to
Sigma Recovery Group. Only the judgment owner is allowed to enforce and collect
a judgment, that is why the transfer of rights is needed. 
 The Contingency Fee Agreement is used as the contract for payment to the Assignor (You),
 as consideration for the assignment of the judgment. 
 This form will need to be signed by the judgment creditor/s, notarized and mailed back
to us. Once we receive the Acknowledgement of Assignment of Judgment Agreement,
it will be recorded with the courthouse of the county where the judgment was awarded.
Execution of collection
 Based on the planned strategy, the Recovery Specialist will execute which ever of 
the actions as needed and not limited to:
  • Garnishment of wages.
  • Placement of levy on bank accounts (checking and/or savings) safe deposit boxes,
       any type of stocks, mutual funds.

  • Seizure and auction of vehicles, equipment and personal property of value.
  • Place liens on real property, if the debtor own property for investment purposes,
      we will force to have it auctioned off by court order.

 Please keep in mind, that one or  all of these methods may not satisfy the judgment,
further effort will need to be made in order to recovery the balance of the judgment.

Payment of monies recovered

Once any amount of funds have been recovered, you will be paid your agreed 
percentage from those funds. We can not guarantee that all or if any funds can 
be recovered, various factors can restrict us from recovery:
  • The debtor has filed for bankruptcy (We make an effort to have your judgment non
      dischargeable)

  • The debtor simply can not be located.
  • The debtor does not have any assets to satisfy the judgment.  
  • The debtor is incarcerated.
Post Recovery
 Once we have successfully recovered the funds to satisfy the judgment, will file and
 record a satisfaction of judgment with the clerk of courts.
